Terms & Conditions — Brand Scale

Welcome to Brand Scale ("Brand Scale", "we", "us", "our"). These Terms & Conditions ("Terms") govern your use of our website brandscale.agency, our digital marketing services, and our online shop (digital downloads and physical products). By accessing the website, purchasing a product, or engaging a service, you agree to be bound by these Terms.

1. About us

Brand Scale is a digital growth agency based in 1st floor, 30/10 A, C block Tajmahal Rd, Mohammadpur, Dhaka 1207. We offer SEO & content marketing, web design & development, branding & graphic design, performance ads, AI marketing consulting, and e-commerce growth services, alongside digital and physical products in our shop.

2. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order or sign an agreement with Brand Scale.

3. Accounts

Some features (order history, digital downloads, account management) require an account. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at brandscalebd@gmail.com if you suspect unauthorized access.

4. Services

Project scope, deliverables, timelines, and payment milestones are documented separately in a proposal, statement of work, or service agreement before any work begins. Those project documents take precedence over these Terms wherever they conflict, but only for that specific engagement.

We rely on you to provide accurate brand assets, credentials, content, and timely feedback. Delays caused by missing inputs may shift agreed deadlines.
Unless otherwise stated, third-party costs (paid ads spend, premium plugins, stock licenses, hosting) are billed separately or paid by you directly.
Final ownership of custom deliverables transfers to you only after the project is paid in full.

5. Shop — orders and pricing

All prices in the shop are listed in Bangladeshi Taka (৳ / BDT) and include applicable taxes unless stated otherwise. We may update prices, product descriptions, and stock at any time. Submitting an order is an offer to purchase; the order is confirmed only when we accept it and send a confirmation.

5.1 Payment methods

We currently accept Cash on Delivery (COD), bKash, and card payments. You authorize us (and our payment processors) to charge the total order amount, including any shipping or applicable fees, using your chosen payment method.

5.2 Physical products

Shipping rates and estimated delivery windows are shown at checkout based on your delivery address.
Delivery times are estimates. Delays caused by couriers, weather, or holidays are outside our control.
Please inspect the package on delivery. Report damage or missing items within 48 hours by emailing brandscalebd@gmail.com with photos and your order number.

5.3 Digital products

Digital products (courses, templates, toolkits, notebooks in PDF form) are delivered through a download link tied to your order and, when applicable, your account.
Download links may expire after a stated period or download limit, shown on the product page. Contact us if a valid link stops working.
Digital products are licensed to a single buyer for personal or single-business use. Resale, redistribution, or sharing of files is not permitted.

6. Refunds & cancellations

Physical products: You may request a return within 7 days of delivery if the item is unused, undamaged, and in original packaging. Return shipping is the buyer's responsibility unless the item arrived defective or incorrect.

Digital products: Due to the nature of digital goods, all sales are final once the file has been downloaded. If you experience a technical issue with delivery, contact us within 7 days and we will fix the problem or issue a refund at our discretion.

Services: Service refunds follow the cancellation clause in the signed project agreement. Work already completed (including discovery, strategy, and design iterations) is non-refundable.

7. Intellectual property

All website content, brand assets, course materials, templates, and source files produced by Brand Scale remain our intellectual property until full payment is received. After full payment, custom client deliverables are licensed or transferred to you as stated in the project agreement.

You may not copy, reverse-engineer, redistribute, or republish any part of our website, shop products, or proprietary materials without prior written permission.

8. Acceptable use

You agree not to:

Use the website or services for any unlawful or fraudulent purpose.
Attempt to gain unauthorized access to our systems or other users' accounts.
Upload malicious code, spam, or content that infringes third-party rights.
Scrape, mirror, or harvest data from the site without permission.

9. Third-party services

Our website and operations may use third-party tools (analytics, payment processors, hosting, email, advertising platforms). Their availability, performance, and policies are governed by their own terms, and we are not liable for their outages or actions.

10. Disclaimers

We provide our website, services, and products on an "as is" and "as available" basis. While we work hard to deliver measurable results, marketing outcomes depend on many factors and we do not guarantee specific revenue, traffic, ranking, or ROI numbers.

11. Limitation of liability

To the maximum extent permitted by law, Brand Scale's total liability for any claim arising out of or related to these Terms, a service engagement, or a shop order is limited to the amount you paid for the specific service or product giving rise to the claim in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages.

12. Termination

We may suspend or terminate your account or order if you breach these Terms, misuse our services, attempt fraudulent payments, or violate applicable law. You may close your account at any time by contacting us.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. Continued use of the website or services after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
